Terms and conditions

These Terms and Conditions ("Agreement") govern the provision of services by Beitian Private Limited, located at Redhills(Erragattugutta), Hanamkonda, to any client. By engaging with Beitian Private Limited for services including but not limited to Web Development, Mobile Development, Quality Assurance (QA), DevOps, Search Engine Optimization (SEO), and Artificial Intelligence (AI) services, you agree to abide by the following terms.

  1. Services

      We collect various types of information depending on your interaction with us, which may include:

    1. Scope of Services

      Beitian Private Limited offers a range of services including Web Development, Mobile Development, QA, DevOps, SEO, and AI services. The scope, deliverables, timeline, and pricing for each service will be agreed upon in a separate contract or work agreement between the Company and the Client.

    2. Customizations

      Any changes to the project scope, deliverables, or timeline after the initial agreement will be subject to additional fees and/or an extension of delivery deadlines. All changes must be agreed upon in writing.

  2. Client Responsibilities

    1. Provision of Information

      The Client agrees to provide accurate, complete, and timely information required for Beitian Private Limited to perform the services. Failure to provide requested information may result in delays or inability to complete the project, for which Beitian Private Limited shall not be held liable.

    2. Cooperation

      The Client agrees to cooperate with Beitian Private Limited during the project, including participation in reviews, providing feedback, and adhering to agreed timelines for approvals.

  3. Payments and Fees

    1. Payment Terms

      The payment schedule and pricing for services will be outlined in the work agreement or proposal provided to the Client. Payments are to be made as per the agreed milestones or as otherwise stated in the agreement.

    2. Late Payments

      Late payments beyond the agreed payment terms may result in a suspension of services. Beitian Private Limited reserves the right to charge interest at a rate of some % per month on overdue balances, where percentage varies from client to client..

    3. Taxes

      All service fees are exclusive of taxes unless otherwise specified. The Client is responsible for any applicable taxes, duties, or other charges imposed by governmental authorities.

  4. Intellectual Property

    1. Ownership of Deliverables

      Upon full payment, the Client will own the final deliverables created under the agreement, unless otherwise stated. Beitian Private Limited retains the right to reuse generic components, libraries, or methodologies developed during the project.

    2. Third-Party Materials

      Beitian Private Limited may use third-party software, tools, or libraries as part of the deliverables. The ownership and usage rights of these materials will be governed by their respective licenses. Beitian Private Limited will inform the Client about any third-party dependencies in the project.

  5. Confidentiality

    Both parties agree to keep confidential any proprietary or sensitive information disclosed during the course of the project. This obligation remains in effect after the termination of the agreement.

  6. Warranties and Disclaimers

    You have the following rights regarding your personal information:

    1. Service Warranty

      Beitian Private Limited warrants that it will perform the services in a professional and workmanlike manner. However, we do not guarantee that the services or deliverables will be error-free or meet the Client’s specific needs.

    2. Third-Party Software

      Beitian Private Limited is not responsible for issues arising from third-party software or tools used as part of the project.

    3. Limitation of Liability

      In no event will Beitian Private Limited be liable for any indirect, incidental, special, or consequential damages arising from the use of our services, including but not limited to loss of revenue, data, or business opportunities.

  7. Indemnification

    The Client agrees to indemnify and hold harmless Beitian Private Limited from any claims, damages, liabilities, or expenses arising out of the Client’s use of the services, breach of the agreement, or violation of applicable laws.

  8. Termination

    1. Termination by Client

      The Client may terminate this agreement by providing written notice at least 30 days in advance. The Client will be responsible for payment of all services rendered up to the date of termination.

    2. Termination by Beitian Private Limited

      Beitian Private Limited reserves the right to terminate the agreement if the Client fails to comply with these terms and conditions, fails to make timely payments, or engages in any unlawful activity.

  9. Force Majeure

    Beitian Private Limited shall not be held responsible for delays or failure to perform its obligations under this agreement if such delay or failure results from circumstances beyond its control, including but not limited to acts of God, natural disasters, war, strikes, or changes in laws.

  10. Dispute Resolution

    In case of any dispute arising out of or in connection with this agreement, the parties agree to first attempt to resolve the issue amicably through negotiation. If a resolution is not reached, the matter will be referred to arbitration in Hyderabad,Telangana.

  11. Governing Law

    This agreement shall be governed by and construed in accordance with the laws of Telangana, India.

  12. Amendments

    Beitian Private Limited reserves the right to amend these Terms and Conditions at any time. Any changes will be communicated to the Client in writing. Continued use of our services after amendments indicates acceptance of the new terms.

  13. Entire Agreement

    This Agreement constitutes the entire agreement between the Client and Beitian Private Limited regarding the services provided and supersedes all prior agreements or understandings, whether written or oral.
    14. By engaging Beitian Private Limited for services, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
